USE OF APPLICATION

This Application may be used for your own private purposes and in accordance with these terms of use. You may print and download material from this Application provided that you do not modify or reproduce any content without our prior written consent and by providing due reference to the Application. The material published on the application is published by multiple users and hence we take no responsibility in its correctness. Ayurv or Logieagle Private Limited (Application publisher) does not have the means to acertain the accuracy of the information and It's expected that the individual user applies complete due diligence before using any of the procedures/medicines prescribed by any of the user stories published on the application.

YOUR REGISTRATION INFORMATION

Your account on the Application gives you access to the services and functionality that the Company establishes and maintains from time to time. When requesting services from the company, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. That Login ID and password, together with your mobile number or other contact information you provide during your registration. We encourage you to use strong passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. You must notify the Company immediately of any breach of security or unauthorized use of your account. The Company will not be liable for any losses caused by any unauthorized use of your account.

You may control your user profile and how you interact through the Application and through the use of products and services by changing the settings therein. By providing your email address you consent to our using the email address to send you service-related notices, including any notices required by law, in lieu of communication by postal mail. We may also use your email address to send you other messages, such as changes to features of the Products and Services and special offers. If you do not want to receive promotional email messages, you may opt out by unsubscribing from such email communications. Opting out may prevent you from receiving email messages regarding updates, improvements, or offers.

USE OF REGISTERED MOBILE NUMBER

Ayurv reserves the right of sending SMS on your registered mobile number for following purposed.
a) Sending OTP for authenticating your mobile number and Ayurv account.
b) Sending OTP for password Reset of your Ayurv account.
c) Sending Account related other information over SMS.
d) Other promotional schemes and offers.
e) Reminder for renewal of annual subscription.
f) For updating you about our App and new services.

USE OF PERSONAL DETAILS

Ayurv will not pass on any of your personal account details to anyone other than our payment services provider. Ayurv cannot be held responsible for any loss or misuse that may be suffered due to any third party company involvement.

APPLICATION UPTIME

All reasonable measures are taken by us to ensure that this Application is operational continuously 365 days, 24x7. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this Application is unavailable at any time. Where possible we always try to give advance warning of maintenance issues that may result in Application down time but we shall not be obliged to provide such notice.

LOG FILES

We also review data and information contained in log files located on our web server, which record the date and time of each visit to our Application, the user's IP (Internet protocol) address, the referring IP address or domain (the prior Application visited), and the files viewed on our Application (including HTML pages, graphics, etc.). We use log file information to analyse data in the aggregate to determine the trends and usage of our site. We do not, and will not, disclose, sell, rent or share any information derived from log files with any third parties.

ASSIGNMENT

Company may assign all or part of the right or duties of company under this agreement to another party by giving sufficient notice to its customers without such assignment being considered a change to the agreement.

Any material that a visitor to this Application sends or posts to this Application shall be considered non-proprietary and non-confidential. We shall be entitled to copy, disclose, distribute or use for such other purpose as we deem appropriate all material provided to us, with the exception of personal information, the use of which is covered under our Privacy Policy When using this Application you shall not post or send to or from this Application any material: for which you have not obtained all necessary consents; that is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in the United Kingdom; which is harmful in nature including, and without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data. We will fully co-operate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this Application in breach of the terms and conditions.

ACCESS AND INTERFERENCE

You agree that you will not:
a) Use any robot, spider, scraper, deep link or other similar automated data gathering or extraction tools, program, algorithm or methodology to access, acquire, copy or monitor the Application or the Products and Services or any portion of it, without the Company's express written consent, which may be withheld in the Company's sole discretion;
b) Use or attempt to use any engine, software, tool, agent, or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search the Company, other than the search engines and search agents available through the Application and other than generally available third-party web browsers (such as Microsoft Explorer);
c) Post or transmit any file which contains viruses, worms, Trojan horses or any other contaminating or destructive features, or that otherwise interfere with the proper working of the Application or the Products and Services; or
d) Attempt to decipher, decompile, disassemble, or reverse-engineer any of the software comprising or in any way making up a part of the Application or Products and Services.
e) Users agree not to use or launch any automated system, including, without limitation, "robots," "spiders," "offline readers," etc., that accesses the Application or Products and Services in a manner that sends more request messages to its servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser.

UNAUTHORIZED USE

Customer may not program or alter any of the devices other than the normal programmable parameters of the devices. We have reserved all right to interrupt services or restrict services.

EXCLUSION OF LIABILITY

We do not accept liability for any loss or damage that you suffer as a result of using this Application. Nothing in these Terms of Use shall exclude or limit liability for death or personal injury caused by negligence which cannot be excluded or under the law of the India.

DISCLAIMER

Whilst we do take all reasonable steps to guide users on this Application to post upto date and accurate information at all times, we do not guarantee that all material is accurate and ,or up to date. All material contained on this Application is provided without any or warranty of any kind. You use the material on this Application at your own discretion. You understand and agree that any alerts provided to you through the use of Application and Products and Services may be delayed or prevented by a variety of factors which are not under the control of Company. The Company does its best to provide alerts in a timely manner with accurate information. However, we neither guarantee the delivery nor the accuracy of the content of any alert. You also agree that the Company shall not be liable for any delays, failure to deliver, or misdirected delivery of any alert; for any errors in the content of an alert; or for any actions taken or not taken by you or any third party in reliance on an alert.

INDEMNITY

You agree to defend, indemnify and hold harmless the Company and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:
(i) your use of and access to the Application and Products and Services, including any data or content transmitted or received by you;
(ii) your violation of any term of this Agreement, including without limitation your breach of any of the representations and warranties above;
(iii) your violation of any third-party right, including without limitation any right of privacy or Intellectual Property Rights;
(iv) your violation of any applicable law, rule or regulation;
(v) any claim or damages that arise as a result of any of your User Content or any that is submitted via your account; or
(vi) any other party's access and use of the Service with your unique username, password or other appropriate security code.
Further, you agree that, if you are using our Products and Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify the Company and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Products and Services or violation of any of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys' fees..

COMPANY’S LIABILITY FOR ITS SERVICES

It is agreed by you that, when permitted by law, the Company, will not in any way be responsible for loss profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages. In all cases, the Company, will not be liable for any loss or damage that is not reasonably foreseeable. The Company shall address any discrepancies and grievances that you may have regarding the use of the Products and Services in a time bound manner. For this purpose, the Company has designated a grievance officer who shall redress the grievances within one month 'from the date of receipt of grievance. LAW AND JURISDICTION

These terms of use are governed by Indian law. Any dispute arising in connection with these terms of use shall be subject to the exclusive jurisdiction of the Courts of Ahmedabad, Gujarat.
